SHIPPING, RISK OF LOSS, FINAL SALE, AND RETURNS

Shipping dates are estimates only and not guaranteed.

Title and risk of loss pass to you upon receipt. We are not responsible for carrier delays. If products are lost or damaged prior to delivery, we will work with you toward a resolution, which may include replacement or refund at our discretion.

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, EXCEPT WHERE PROHIBITED BY LAW.

INDEMNIFICATION

You agree to indemnify and hold harmless USURE COMMUNE and its affiliates from claims arising out of your violation of these Terms or misuse of the Service.

DISPUTE RESOLUTION, BINDING ARBITRATION, AND CLASS ACTION WAIVER

Informal Resolution

Before arbitration, you agree to contact hello@usurecommune.com with a written description of the dispute.

Agreement to Arbitrate

Disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Location

Unless required otherwise by law, arbitration shall take place in Los Angeles County, California.

Small Claims

Eligible claims may be brought in small claims court in Los Angeles County, California.

Class Action Waiver

All disputes must be brought individually. Class and representative actions are waived.

Opt-Out

You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing hello@usurecommune.com with your full name, address, and clear intent to opt out.

GOVERNING LAW

These Terms are governed by the laws of the State of California.

FORCE MAJEURE

We are not liable for delays caused by events beyond reasonable control.

SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full force.

TERMINATION

We may terminate or suspend access at any time for violations of these Terms. Obligations incurred prior to termination survive.

WAIVER AND ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and USURE COMMUNE and supersede all prior agreements.
